Terms of Service

Effective date: January 1, 2025

1. Service Description

SMS Activate provides virtual phone numbers for the purpose of receiving SMS verification codes from third-party services. The service operates on a prepaid credit basis. Users purchase credits, which are then spent to acquire temporary virtual phone numbers. We do not provide voice call services, and numbers are provisioned for SMS reception only.

The service is provided "as is" without warranty of any kind, express or implied. Availability of numbers for specific countries or services may vary and is subject to change without notice.

2. Eligibility

You must be at least 18 years of age to use this service. By creating an account, you represent and warrant that you meet this age requirement. Use of the service by persons under 18 is prohibited.

You must have the legal capacity to enter into a binding agreement in your jurisdiction. If you are using the service on behalf of a legal entity, you represent that you have the authority to bind that entity to these Terms.

3. User Responsibilities

You agree to use the service solely for lawful purposes. The following uses are strictly prohibited:

- Using numbers to facilitate illegal activity, including but not limited to fraud, identity theft, or unauthorized access to accounts. - Sending or facilitating spam, unsolicited messages, or bulk commercial messaging. - Circumventing verification systems in violation of a third-party service's terms of use. - Reselling or transferring credits or numbers to third parties without explicit written authorization. - Engaging in any activity that disrupts or interferes with the service infrastructure.

Violation of these prohibitions may result in immediate account termination without refund.

4. No Guarantees on SMS Delivery

SMS delivery depends on factors outside our control, including carrier routing, third-party platform behavior, and geographic availability. We make no guarantee that:

- A given number will receive an SMS within any specific time period. - A specific service or platform will accept a number from a given country. - The same number will remain available for repeated use.

We operate on a best-effort basis. If SMS is not received within the activation window, the credit refund policy (Section 5) applies.

5. Refund Policy

Credits are non-refundable once purchased, with one exception: if an activation fails — meaning no SMS code was received during the activation window — the cost of that activation is automatically returned to your account balance as credits.

No cash refunds are issued. All refunds take the form of credit balance restoration.

We reserve the right to investigate and deny refund credits in cases where abuse or manipulation of the refund mechanism is suspected.

6. Account Termination

We reserve the right to suspend or permanently terminate any account at our discretion, with or without notice, for:

- Violation of these Terms - Suspected fraud or abuse - Chargebacks or payment disputes - Activity that creates legal or regulatory risk for the service

Upon termination, remaining credits may be forfeited. If termination was in error, contact support within 30 days.

7. No Service Level Agreement

We do not offer any guaranteed uptime, availability SLA, or service continuity commitments. The service may be interrupted for maintenance, technical issues, or at our discretion. We are not liable for losses resulting from service downtime or unavailability of specific numbers.

8. Intellectual Property

All content, software, and infrastructure comprising the service is owned by or licensed to SMS Activate. You may not copy, modify, distribute, or reverse engineer any part of the service without explicit written permission.

The SMS Activate name, logo, and associated marks are proprietary. Use of these marks without authorization is prohibited.

9. Limitation of Liability

To the maximum extent permitted by applicable law, SMS Activate and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

Our total liability for any claim arising from use of the service is limited to the amount of credits purchased in the 30 days prior to the claim.

10. Changes to These Terms

We may update these Terms at any time. When we do, we will update the effective date at the top of this page. Continued use of the service after changes constitutes acceptance of the revised Terms.

If you do not agree with changes to these Terms, you should stop using the service and contact support if you have remaining credits.
